Terms of Service

Last updated: April 1, 2026

These Terms of Service ("Terms") govern your access to and use of Merit Loom ("we", "us", or "our"), including our website, practice content, mock tests, and related services (collectively, the "Services"). By creating an account or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Acceptance of Terms

By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new "Last updated" date. Your continued use of the Services after such changes constitutes acceptance of the revised Terms.

2. Description of Services

Merit Loom provides online preparation materials for language certification exams, including practice questions, audio modules, and (where available) mock tests for exams such as FIDE, TELC, TEF, Goethe-Zertifikat, and CILS at various CEFR levels.

We do not administer, grade, or issue any official exam certifications. Merit Loom is an independent study platform and is not affiliated with, endorsed by, or sponsored by any official exam body or certification authority.

3. Eligibility and Accounts

You must be at least 16 years old to create an account. By registering, you agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms, contain inaccurate information, or are used in a manner that disrupts the Services or harms other users.

4. Subscriptions, Payments and Billing

Paid tiers (such as Premium Practice and Mock Tests) are sold per exam, per language (where applicable), and per CEFR level. Subscriptions auto-renew monthly until cancelled. All payments are processed by Paddle, our merchant of record, which handles tax collection and remittance where required.

Prices are shown inclusive of applicable taxes. By subscribing, you authorize us (via Paddle) to charge your selected payment method on each renewal date until you cancel. You can cancel anytime from your dashboard; cancellation stops future renewals but does not refund the current paid period.

For details on accepted payment methods, refunds, currency, and billing disputes, see our Refund Policy.

5. Acceptable Use

You agree not to: (a) share your account credentials or transfer your subscription to others; (b) copy, scrape, redistribute, resell, or publicly post our practice content; (c) attempt to reverse-engineer, decompile, or interfere with the Services; (d) use automated systems (bots, scrapers) to access the Services; or (e) use the Services for any unlawful purpose.

Practice questions, audio, explanations, and other study material are licensed to you for personal, non-commercial use only. Violations may result in immediate account termination without refund.

6. Intellectual Property

All content on the Services — including text, questions, audio, graphics, software, and design — is the property of Merit Loom or its licensors and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for your personal exam preparation. No other rights are granted by implication or otherwise.

7. Disclaimers

The Services are provided on an "as is" and "as available" basis. While we work hard to keep our practice content aligned with current exam patterns, we do not guarantee any specific exam outcome, score, or pass result. Real exam content, format, and scoring are controlled solely by the relevant exam authorities and may change without notice.

We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

8. Limitation of Liability

To the maximum extent permitted by law, Merit Loom and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or exam opportunities — arising from your use of or inability to use the Services.

Our total aggregate liability for any claim relating to the Services is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim, or USD 50, whichever is greater.

9. Termination and Suspension

You may stop using the Services and delete your account at any time. We may suspend or terminate your access to the Services, with or without notice, if you breach these Terms, abuse the Services, or if we are required to do so by law.

Upon termination, your right to use the Services ceases immediately. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.

10. Governing Law, Changes and Contact

These Terms are governed by the laws of the jurisdiction in which Merit Loom is established, without regard to its conflict-of-law principles. Any disputes arising out of or relating to these Terms shall be resolved in the courts of that jurisdiction, unless otherwise required by mandatory consumer protection law.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right or provision is not a waiver of that right or provision.

If you have questions about these Terms, please contact us via our contact page or email legal@meritloom.com.
